Telephone and environmental wiretaps can involve you even if you are not the direct suspect: you might speak with someone under surveillance, use a phone registered to a family member, or incidentally appear in a conversation. It is natural to wonder who can authorize the listening, for how long, when the defense can access the recordings, and whether every captured phrase can become evidence.

In this guide, I want to help you distinguish between wiretaps ordered by the judicial authority and private recordings, understand the limits of environmental captures and spyware, and recognize the points on which the defense can focus. If the proceedings take place in Milan, the rules remain national: what changes from case to case are the alleged crime, the content of the decrees, and the way conversations are used.

What is meant by wiretapping

Wiretapping secretly acquires an ongoing communication through the intervention of a person outside the conversation. It can concern telephone calls, other telecommunications, computer or telematic flows, and conversations between people present in the same place. The listening must take place without the interlocutors being aware of it and while the communication is ongoing.

Telephone wiretaps concern the content of communications carried out through a device or a network. Environmental wiretaps, called by the code “intercepts between persons present”, allow instead listening to what is said in an environment. The place of capture matters, especially when it coincides with a dwelling or another protected space such as a domicile.

Spyware is a program inserted into a portable electronic device, such as a smartphone, which can allow the activation of the microphone and the listening of conversations in the surrounding environment. It is therefore not a simple telephone wiretap: the device can become an environmental listening tool, within the limits indicated by the judicial provision.

A recording made by one of the interlocutors does not automatically coincide with a wiretap regulated by articles 266 and following of the code of criminal procedure, because the person recording participates in the conversation. However, issues relating to admissibility, the dissemination of the file, and the methods by which the recording was obtained remain distinct. Call logs are also different: they document data relating to communications, not their content.

When the judicial authority can order listening

Not every investigation allows wiretapping. Article 266 of the code of criminal procedure identifies categories of crimes and penalty thresholds. Generally speaking, non-culpable crimes punished with life imprisonment or imprisonment exceeding five years in the maximum are included; for certain crimes against public administration, the threshold is a maximum penalty of not less than five years. The norm also includes specific crimes expressly listed. The complete reference is in the text of Article 266 of the code of criminal procedure.

The precise qualification of the fact is decisive. The generic name attributed to the investigation is not enough: it is necessary to consider the crime for which the wiretap was authorized, the penalty provided by law, and any circumstances affecting the calculation. A capture admitted for a specific allegation does not automatically become legitimate for any other offense that emerged during the listening.

Conversations inside the domicile

For wiretaps between persons present in places protected as a domicile, the ordinary discipline requires an additional limit: there must be well-founded reason to believe that criminal activity is taking place in that place. A house, a private room, or another space attributable to Article 614 of the criminal code therefore receives greater protection than a place open to the public.

The rule encounters particular regulations for certain investigations, especially regarding organized crime, terrorism, and certain crimes against public administration. The use of spyware also requires a motivation referring to the concrete necessity of that method and, when provided, the places and times in which the microphone can be activated. A generic authorization to listen is not enough.

Authorization, urgency, and duration of operations

In the ordinary regime, the judge for preliminary investigations decides, upon request by the public prosecutor. Article 267 requires serious indications of a crime and the absolute indispensability of the wiretap to continue investigations. The decree must be motivated: the compression of the secrecy of communications, protected by Article 15 of the Constitution, cannot depend solely on the initiative of the judicial police. This principle is also illustrated by judgment no. 34 of 1973 of the Constitutional Court.

In urgent cases, the public prosecutor can order the wiretap with their own motivated decree when delay risks causing serious prejudice to the investigations. Control by the judge remains necessary: the provision must be communicated immediately and in any case within twenty-four hours; the judge decides on validation within the subsequent forty-eight hours. Without validation, operations cannot continue and the results are not usable. Prerequisites and procedure are indicated in Article 267 of the code of criminal procedure.

The ordinary duration is divided into periods of fifteen days, extendable by the judge with a motivated decree if the initial prerequisites remain present. Starting from April 24, 2025, the total duration cannot, as a general rule, exceed forty-five days. Exceeding this requires that the absolute indispensability of the continuation be justified by specific and concrete elements that emerged during operations, with express motivation. The amendment is contained in Law no. 47 of March 31, 2025.

Forty-five days is not, however, a universal limit. For investigations into organized crime and other hypotheses provided by special laws, different durations and conditions operate. Starting from December 17, 2025, the legislature has also excluded the application of the general ceiling for further serious offenses expressly identified. Therefore, the duration must be checked in relation to the crime, the applicable discipline, and each single extension decree.

How recordings enter the proceedings

Being listened to does not mean automatically being under investigation. The wiretap may concern a line used by the person under investigation, a place they frequented, or a device belonging to a third party. Conversations of family members, colleagues, or other people may be incidentally captured. Their relevance depends on the content and the connection with the facts subject to the proceedings.

Operations are recorded and documented through minutes. The judicial police select the material according to procedural rules, but the initial summary does not exhaust the content of the recording. An isolated phrase can assume a different meaning by listening to what precedes and follows it, correctly recognizing voices, or placing the dialogue in its context.

Content not relevant to the investigations must not be transcribed even summarily in the minutes, except for the indication required by law to signal the omission. The discipline aims to prevent private information unrelated to the assessment from circulating in the files. This protection was reinforced by the amendments to Article 268 contained in Law no. 114 of August 9, 2024, published in the Official Gazette.

The defender can access the material at times established by the code, listen to the deposited recordings, and indicate the conversations deemed relevant. The judge decides on acquisition, excluding what is unusable or manifestly irrelevant. The defense can challenge an incomplete transcription, the identification of the speaker, the audio quality, or the meaning attributed to ambiguous expressions.

When a wiretap cannot be used

An unfavorable conversation is not unusable just because it is private. Inadmissibility depends on the violation of specific prohibitions: for example, wiretaps carried out outside the cases permitted by law, non-observance of the essential conditions provided by Articles 267 and 268, or acquisition of communications protected by a particular prohibition.

Communications between the assisted person and their defender receive specific protection when they concern professional activity. The presence of the lawyer's name is not enough on its own: the identity of the interlocutors, the function in which the defender communicates, and the relationship of the conversation with the mandate matter. Content must therefore be distinguished from conversations unrelated to the exercise of defense.

Results born in one proceeding cannot be freely transferred to any other investigation. Article 270 allows use in different proceedings only within the exceptions provided by law. It is necessary to distinguish a new proceeding from a different charge internal to the same story, considering the connection between the facts and the type of crime that emerged.

When a recording is declared unusable, it cannot form the basis of the decision as evidence. In some cases, the judge also orders the destruction of the relative documentation. The exception must indicate the concrete violation: arguing generically that the listening is illegitimate, without engaging with authorization, extensions, and operational methods, does not clarify the procedural problem.

Secrecy, publication, and privacy protection

Procedural access and publication are different issues. A recording can be knowable by the parties to exercise the right of defense without being able to be disseminated in newspapers, on social networks, or in other public spaces. From the current text of Article 114 of the code of criminal procedure derives the prohibition to publish, even partially, the content of wiretaps when it has not been reproduced by the judge in the motivation of a provision or used in trial. The amendment is reported in Legislative Decree no. 198 of December 10, 2024.

Recordings and documents are kept in the wiretap archive, with regulated accesses. Storage does not authorize indiscriminate circulation. When the documentation is no longer necessary for the proceedings, interested persons can request its destruction to protect confidentiality; the judge decides by evaluating whether procedural needs persist.

Protection also concerns those who are not accused of any crime. If a conversation contains information about health, family, or personal relationships devoid of investigative importance, its extraneousness to the facts represents a central element. The defense of confidentiality does not, however, coincide with the cancellation of relevant evidence: the judge must balance private life with the needs of the assessment.

What you can do when you discover a capture

The first step is to understand what kind of acquisition it is. A phrase reported in a precautionary order, a recording attached to a complaint, a file created by one of the interlocutors, and listening ordered by the judge follow different rules. Confusing them can lead to challenging the wrong provision or overlooking a truly important problem.

If the wiretap appears in the files of a proceeding, the point is not just to establish whether the phrase was spoken. The crime for which the listening was authorized, the initial decree, extensions, the line or place monitored, the identification of voices, the completeness of the dialogue, and the connection with the accusation all matter. A transcription is a representation of the audio file and does not always replace direct listening.

Possible initiatives vary. The defense can ask for the acquisition of favorable conversations or those necessary to understand the context, challenge the usability of those obtained in violation of the law, or discuss the interpretation proposed by the prosecution. If the problem concerns irrelevant private information, their exclusion from documents destined for circulation or, when the prerequisites are met, destruction can assume relevance.

If instead you suspect that a private individual has installed a listening device or program on your phone, avoid altering the device or deleting files. Photographs, system messages, anomalous accesses, and technical assessments can help reconstruct what happened. Recording made by a present interlocutor and hidden capture carried out by an outsider pose different legal problems.

Frequently asked questions

Can I know if my phone is wiretapped?

During investigations normally no, because secrecy is necessary for the functioning of the tool. Capture may emerge later from a provision, the filing of acts, or the notice of conclusion of investigations. Someone who was incidentally recorded and does not become part of the proceedings might not receive a personal communication.

Can a wiretap last more than forty-five days?

Yes, but the general limit cannot be exceeded automatically. In the ordinary regime, specific and concrete elements that emerged during operations, absolute indispensability, and express motivation are needed. For organized crime and other fattispecie indicated by special rules, different rules operate, therefore crime and sequence of decrees must be considered together.

Can I ask to listen to the complete recordings?

The defender can access deposited recordings according to times and methods provided by the code, listen to them, and indicate those relevant for the defense. Not all captures automatically become part of the usable file. If a transcription omits the context or attributes a voice in a challengeable way, the original audio assumes particular importance.

Can a phone call with my lawyer be used against me?

Communications relating to defensive activity are protected and results acquired in violation of the prohibition are not usable. However, it is necessary to verify that the conversation effectively involves the defender in the exercise of their function and concerns the mandate. Communication unrelated to professional activity does not automatically receive the same protection.

Can I publish a recording present in the files?

Access to the file does not imply the right to publish it. The code prohibits the publication of the content of wiretaps when it has not been reproduced by the judge in the motivation of a provision or used in trial. Dissemination can also involve third-party privacy and other responsibilities, even if the file is procedurally knowable.

Navigating the concrete case

To understand the weight of a wiretap, precise distinctions are needed: who recorded, what means was used, what crime was the object of the investigation, what the decrees authorized, and how the content entered the files.
