Criminal Lawyer

The record of identification and election of domicile may be the first document from which you understand that criminal proceedings concern you. It is natural to wonder if it equates to a definitive accusation, why a lawyer is indicated, and what the chosen address for notices entails. Even the signature can create doubts: does it mean acknowledging the facts or does it merely confirm what is reported in the document?

I want to help you distinguish the different functions of the record and, above all, understand which decisions produce effects in the course of the proceedings. I will explain what is needed to identify you, what difference exists between declaring and electing domicile, what communications can reach the defense counsel, and what to do if you change your home, contact details, or lawyer.

What the record is and what receiving it means

The record documents certain formal requirements carried out by the judicial police against the person subjected to investigations. As a rule, it reports identifying data, the indication of the domicile chosen for certain notifications, the warnings provided by law, and information relating to retained or court-appointed defense counsel.

Its delivery does not equal a conviction and does not prove that the proceedings will necessarily lead to a trial. However, it signals that, at that moment, the authority considers you a person against whom investigations are being conducted. The public prosecutor may then request dismissal, proceed with further investigations, or exercise criminal action, depending on what emerges.

The record may indicate the rule believed to have been violated, the date and place of the fact, and the proceeding authority, when such information is already available. The initial classification is not always definitive: the hypothesized crime, the contested facts, or the role attributed to individuals can be specified during the investigations. For this reason, the document does not replace knowledge of the files that become accessible according to the rules of the proceedings.

It is also necessary to distinguish the identification of a suspect from that of a person informed on the facts. Article 349 of the code of criminal procedure allows for the identification of both, but the invitation to declare or elect domicile provided during identification concerns the person subjected to investigations. The concrete content of the document therefore makes it possible to understand in what capacity you have been involved.

Identification is not an interrogation

Identification means ascertaining who you are. The judicial police collect personal details and may perform, when necessary, photographic, fingerprint, or anthropometric surveys. If certain checks involve taking hair or saliva without the interested party's consent, Article 349 requires the authorization of the public prosecutor and respect for personal dignity. The discipline can be consulted in the text of Article 349 of the code of criminal procedure.

Personal details must be truthful. The right to defense and the faculty not to answer on the facts do not authorize providing a false identity. Instead, it is important not to confuse biographical questions with possible requests to explain what happened: the identification record alone is not an interrogation and does not require a spontaneous reconstruction of the affair.

If you are invited to recount the facts, you must understand in what type of act the statements will be gathered and which guarantees apply. An improvised explanation can have procedural relevance, even when it arises from the desire to immediately clarify a misunderstanding. Before making statements on the merits, it is therefore reasonable to ask that your position and the role of the defense counsel be specified.

Refusing to be identified or presenting data and documents that there are sufficient reasons to believe are false may entail being escorted to police offices. The stay must last only as long as necessary and, as a rule, cannot exceed twelve hours; it can reach twenty-four hours in cases of particularly complex identification or when an interpreter or consular authority is needed, after notifying the public prosecutor. Being escorted for identification does not automatically coincide with an arrest, but nevertheless constitutes a limitation subject to conditions and controls.

Declaring or electing domicile: the practical difference

Domicile serves to receive important acts of the proceeding, not to establish where you must live. Declaring domicile means indicating a place or contact of your own suitable for notifications. Electing domicile means choosing, for this specific procedural function, a place referable to another person, frequently the defense counsel.

The choice must be concrete. A formally existing address where you do not check correspondence can become unsuitable. Likewise, indicating a family member's home is useful only if that person is informed, regularly receives the acts, and manages to notify you without delays. Convenience is not enough: effective reachability counts.

It is also possible to indicate a certified electronic mail address or another qualified certified delivery electronic service, within the limits provided by Article 161. A forgotten, full, or rarely checked PEC exposes one to the same problems as an unchecked mailbox. The current regulations and the warnings that must appear in the record are reported in Article 161 of the code of criminal procedure.

Election at the defense counsel requires coordination. In the case of court-appointed defense counsel, Article 162, paragraph 4-bis, links the effectiveness of domiciliation to their consent. Therefore, one must not presume that the simple name reported in the record automatically makes every contact point at that professional operational.

Which notifications arrive at the domicile and which at the defense counsel

Not all acts follow the same path. In the current system, after the warnings provided by law, many subsequent notifications are carried out by delivery to the defense counsel. The declared or elected domicile retains a specific function for particularly important acts, including the notice of fixing the preliminary hearing, the citation acts for trial provided by the code, and the penal decree of conviction.

This distinction explains why the record asks you both for a reliable domicile and to maintain real contact with the lawyer. Checking only the mail is not sufficient if other acts are delivered to the defense counsel; similarly, speaking with the lawyer does not render a now-nonexistent or unsupervised domicile irrelevant.

Legislative Decree No. 150 of October 10, 2022, which entered into force on December 30, 2022, reorganized the discipline of notifications and the warnings addressed to the suspect. The relative Article 10 of Legislative Decree No. 150 of 2022 shows which notifications are linked to the domicile and what warnings must be recorded.

If you refuse to declare or elect domicile, or if the contact point is missing, insufficient, or becomes unsuitable, the acts indicated by Article 161 can be delivered to the defense counsel. Refusal therefore does not prevent the proceedings from proceeding. Indeed, it may make it more difficult to learn promptly of a deadline if an effective relationship with the appointed lawyer does not exist.

The defense counsel indicated in the record

You can appoint a retained defense counsel. If you do not, the authority proceeds to designate a court-appointed defense counsel, so that your position does not remain without technical assistance. Court-appointed nomination does not prevent you from subsequently choosing another lawyer, in compliance with the established formalities.

Court-appointed defense counsel is not automatically free of charge. Court-appointed defense ensures the presence of a lawyer, whereas legal aid at state expense is a different institution, subject to economic requirements and other conditions established by law. The fee therefore remains due when the requirements for admission to public aid are not met.

Merely noting the name of the defense counsel is not enough. Updated contact details and a functioning communication channel are needed, because some notifications can be delivered directly to them. You must also communicate how to contact you and inform them of changes in telephone, email, or other available contacts, according to the warnings provided by Article 161.

If a defense counsel appears in the record whom you have not yet contacted, it does not mean they have already received a complete reconstruction of the facts or all the investigative acts. It is useful to distinguish formal designation from the actual start of the defense relationship. The former guarantees that a lawyer is indicated in the proceeding; the latter requires communication and the necessary professional choices.

Signature, errors, and information to check

Signing does not mean confessing. The signature normally documents that the formal statements, warnings, and activities described were collected in the record. Before signing, read the personal data, the indicated address, the name of the defense counsel, and any annotation relating to the delivery or understanding of the notices.

If you find an error, ask for it to be corrected or noted before signing. A wrong street number, an inaccurate PEC, or an incomplete contact point are not harmless details, because they can compromise the arrival of notifications. If you do not understand the language or meaning of the act, report it immediately and ask for the content to be explained to you with adequate assistance.

Refusing to sign does not erase what has been done: the refusal can be reported in the record. The choice should therefore not be used as an automatic reaction to a disagreement. It is more useful to make the concrete error visible, ask for your observation to be registered, and not sign statements on the merits that you did not make or do not recognize.

You can ask for information on the possibility of obtaining a copy and keep the details of the proceeding authority, the date, the proceeding number if indicated, and the defense counsel's contacts. Access to other acts follows different rules and can be limited by investigative secrecy. The record is a starting point, not the entire file.

Changing domicile and preventing missed notices

Domicile can be modified, but the change must be communicated to the proceeding authority in the forms provided by Article 162. The communication can be gathered in the record, presented through the defense counsel, or transmitted in other ways permitted by the rule. A simple informal message to the office or the lawyer does not necessarily replace the procedural fulfillment.

Until the proceeding authority receives the communication, notifications to the previous domicile remain valid according to the discipline of Article 162. If you move, lose access to the PEC, or interrupt relations with the person at whom you elected domicile, the problem must therefore be addressed without waiting for the arrival of a new act.

When the record dates back to a period prior to the notification reforms, the date assumes particular importance. It is incorrect to automatically apply all the rules described for the current system to an old proceeding. The text of the record and subsequent acts must be read according to the discipline applicable at the relevant moment.

To orient yourself after delivery, focus attention on three points: which authority is indicated, which domicile is written, and which defense counsel appears in the act. If the contested fact is not understandable, a request concerning communicable entries pursuant to Article 335 can be considered, taking into account the limits deriving from the secrecy of investigations. Meanwhile, avoid ignoring mail, PEC, or communications from the defense counsel.

Frequently Asked Questions

Does the record mean I am formally accused?

It means you are treated as a person subjected to investigations, if the document contains the fulfillments provided for the suspect. However, it is not a conviction nor does it guarantee a trial will follow. The initial hypothesis can be specified and the proceeding can also conclude with a request for dismissal.

Can I refuse to sign the record?

The refusal does not automatically annul the act and can be noted by the officer. Before deciding, check if the problem concerns a wrong data point, a statement never made, or content not understood: asking for correction or annotation of the contestation is often more useful than an unexplained refusal.

Can I change the indicated domicile?

Yes, domicile can be modified with a communication made in the forms of Article 162 of the code of criminal procedure. Until the proceeding authority receives it, notifications ordered to the previous contact point can remain valid. Therefore, do not rely on a simple civil registry change or an informal message.

Can I elect domicile at my lawyer's office?

Election at the defense counsel is possible, but it is advisable to agree on it and verify that it correctly results in the proceeding. For court-appointed defense counsel, the law provides a specific condition of effectiveness linked to their consent. You must still maintain updated contact, because the lawyer must be able to communicate received acts to you.

Is court-appointed defense counsel free of charge?

No, court-appointed defense and public legal aid are different. Court-appointed defense counsel must be paid, unless you are admitted to legal aid at state expense in the presence of required conditions. You can also appoint a retained defense counsel, having the relative communication correctly executed to the proceeding authority.

What happens if I do not check my domicile?

The proceeding does not stop just because you do not read your mail. A validly executed notification can produce its effects even if you learn the content of the act late. For this reason, you must check your domicile, keep contact details updated, and stay in contact with the defense counsel indicated in the record.

How to orient yourself after delivery

Do not ignore the record and do not interpret it as a sentence. Verify domicile, proceeding authority, and defense counsel; keep the document's details; formally communicate every variation and separate biographical information from any statements on the facts. If the content is not clear or you fear you indicated an unreliable contact point, you can contact me to examine the concrete consequences and available options.
