A minor drug offense is not recognized by simply counting the grams seized. If you are facing criminal proceedings in Milan, specific doubts often concern the intended use of the substance, the weight of the active ingredient, packaging, the manner of the conduct, and the possible presence of prior incidents. The legal framework is national: the location of the proceedings does not change the legal criteria, but makes it important to organize your defense promptly.

In this guide, I explain how personal use is distinguished from drug dealing, when an offense may fall under Article 73, paragraph 5, of the Consolidated Drug Act, and why this classification does not automatically entail the non-punishability provided for by Article 131-bis of the Criminal Code. We will also examine the difference between the particularly minor nature of the offence, probation, and other possible outcomes of the proceedings.

When a drug offense is considered minor

A minor drug offense is an autonomous crime, not a simple mitigating circumstance applied to ordinary drug trafficking. Article 73, paragraph 5, of Presidential Decree no. 309/1990 concerns conduct that, considered in its concrete elements, expresses reduced offensiveness compared to the more serious offenses under the same article.

The law requires consideration of the means employed, the methods and circumstances of the action, as well as the quality and quantity of the substance. For the basic offense, the penalty provided is imprisonment from six months to five years, with a fine ranging from 1,032 to 10,329 euros. If the conduct assumes non-occasional characteristics, the minimum imprisonment rises to eighteen months and the fine starts at 2,500 euros. The current text can be consulted in Article 73 of Presidential Decree no. 309/1990.

No single indicator is decisive on its own. A modest quantity may be part of a stable and organized activity; a larger quantity may instead need to be interpreted together with the concentration of the active ingredient, rudimentary methods, and limited distribution capacity. The assessment must concern the offense as a whole, avoiding favorable or unfavorable automatisms.

Qualification pursuant to paragraph 5 remains possible even in the presence of multiple acts of conduct, but repetition changes the framework. It can affect the recognition of non-occasionality, increase overall offensiveness or, in more structured cases, contribute to excluding the minor offense. It is therefore necessary to distinguish repeated petty dealing from an activity that, due to its organization and dimensions, exceeds the limits of the lesser offense.

Personal use and possession intended for transfer

Before the minor offense comes the intended purpose. If the substance is held exclusively for personal use, the drug dealing crime does not apply, but rather the administrative regulations of Article 75 of Presidential Decree no. 309/1990. If, however, the purpose of transferring the substance to others emerges, even free of charge, the conduct may assume criminal relevance.

Quantity is important, but it does not equate to automatic proof. The text of Article 75 links the finding of exclusively personal use also to the manner of presentation, gross weight, fractionated packaging, and other circumstances of the action. For this reason, a contained quantity, already divided into doses and accompanied by messages regarding deliveries, assumes a different meaning from the same quantity kept unitarily.

A sale that has already taken place is not indispensable to contest possession for the purpose of drug dealing. The intention to transfer can be inferred from convergent elements, but it must be proven and not simply presumed. Packaging, weighing tools, money, conversations, custody methods, and explanations regarding the origin acquire value only if read within their context.

Quantity, active ingredient, and methods of conduct

There is no universal threshold below which the fact automatically becomes minor. The thematic report of the Court of Cassation dedicated to Article 73, paragraph 5, highlights the limited possibility of setting in advance quantitative boundaries valid for every substance and situation. You can consult Report no. 19 of 2023 of the Court of Cassation.

Gross weight indicates how much material has been seized, while the active ingredient expresses the actual quantity of the narcotic substance present. Purity can change the meaning of the weight data: equal gross quantities can have very different drug-inducing capacities. When laboratory analyses are available, their content must therefore be linked to the number of recoverable doses and the other elements of the conduct.

The scope of the activity, the number of recipients, the availability of multiple substances, the division of tasks, and the degree of organization also matter. The presence of different substances does not exclude paragraph 5 on its own, but it can make the offense more serious if it reveals a broad supply or a procurement capacity incompatible with petty dealing.

The simplicity of the means can favor the minor offense, without being decisive. An occasional transfer, devoid of organization and relating to a substance of limited diffusion capacity, presents a different picture compared to scheduled deliveries, constant availability, numerous contacts, and coordinated roles. Even a single search can bring to light elements referable to an activity broader than the quantity found at that moment.

When Article 131-bis may apply

Article 131-bis requires something more compared to the minor offense. Paragraph 5 of Article 73 identifies a less serious form of drug dealing; the particularly minor nature of the offence, on the other hand, excludes the punishability of an act that remains criminally unlawful, when the offense is minimal and the behavior is not habitual.

For the crime of minor drug dealing, the penalty threshold provided by Article 131-bis is abstractly respected, because the statutory minimum does not exceed two years. However, simply recalling the modest quantity is not enough. The judge considers the methods of the conduct, the meager extent of the damage or danger, and also the behavior subsequent to the crime, according to the current text of Article 131-bis of the Criminal Code.

Non-habituality is an autonomous requirement. Non-pertinent prior convictions do not automatically determine rejection, whereas multiple offenses of the same nature or multiple, habitual, and reiterated conduct can prevent the application of the institution. It is also necessary to distinguish non-occasionality provided by Article 73, paragraph 5, from habituality defined by Article 131-bis: these are connected assessments, but based on different rules.

An act can therefore be minor but not particularly tenuous. This happens, for example, when petty dealing is repeated, involves multiple recipients, or presents methods incompatible with minimal harm. Conversely, an isolated transfer of an extremely contained quantity, devoid of organization and accompanied by favorable subsequent elements, can allow for the discussion of both levels of assessment, without any automatism.

Alternatives to ordinary conviction

Defensive options have different effects. Contesting the intention to deal aims to exclude the crime and, if exclusively personal use is established, leads to the administrative plane. Requesting the classification of a minor offense instead recognizes the criminal relevance of the act, but supports the application of the less serious legal category.

Article 131-bis leads to a ruling of non-punishability, not a declaration that the act did not happen. For this reason, it must be distinguished both from acquittal and from proceedings that presuppose different procedural choices. The strategy must be consistent with the evidence: it is not advisable to hastily give up a challenge regarding the destination of the substance simply because the particularly minor nature seems like a shorter path.

Starting from 2025, probation is once again accessible, in the abstract, even for the crime provided for by Article 73, paragraph 5. The Constitutional Court eliminated the preclusion derived from the increase to five years of the maximum statutory penalty. Admission is not automatic: the judge evaluates the requirements and the suitability of the program; a positive outcome extinguishes the crime. The reference is the judgment of the Constitutional Court no. 90 of 2025.

There is also specific community service work provided for by Article 73, paragraph 5-bis, for drug addicts or consumers who have committed a minor offense. It operates upon request and under the conditions established by the rule, as an alternative to custodial and pecuniary penalties when conditional suspension is not to be granted. It does not coincide with probation and intervenes in a different procedural setting.

The elements that concretely change the defense

The first mistake is to isolate the grams. The seizure report describes weight, packaging, location, and recovered objects, but it does not prove on its own either the intent to deal or its severity. The analyses indicate the nature and active ingredient; conversations can explain contacts, provided they are interpreted in their context and not through individual ambiguous phrases.

Cash, precision scales, or packaging materials can strengthen the accusation, but their meaning depends on quantity, location, and connection to the substance. Even an alternative explanation must be concrete and compatible with the other data. The same applies to prior convictions, reports, or distinct episodes: they cannot replace the proof of the contested act, but they can affect non-occasionality and Article 131-bis.

To prepare for a discussion on the situation, it is useful to keep the documents received, available analyses, and data that explain the origin of the money, use of the telephone, or reasons for being at the inspection site. There is no need to construct artificial reconstructions; it is necessary to identify which elements have actual evidentiary value and which ones, instead, allow for multiple interpretations.

Frequently asked questions

Do a few grams always mean a minor drug offense?

No, quantity is not enough. First, the intention to transfer must be proven; then the minor offense is evaluated considering the active ingredient, packaging, means, organization, recipients, and overall circumstances. A few grams can belong to a stable activity, while a larger weight data must still be interpreted together with the other indicators.

Can I obtain Article 131-bis if the offense is already classified as minor?

Yes, but not automatically. Paragraph 5 and Article 131-bis operate at different levels. It is necessary to prove that the offense is particularly tenuous and that the behavior is not habitual. Reiterated conduct, multiple offenses of the same nature, or non-minimal methods can prevent non-punishability even when the minor drug offense remains applicable.

Does a prior conviction always exclude the particularly minor nature?

Not every precedent is decisive. The nature of the precedent, the relationship with the new fact, and the habituality conditions indicated by Article 131-bis matter. Multiple offenses of the same nature or reiterated conduct can be prohibitive; an unrelated precedent, on the other hand, does not allow declaring the behavior habitual on its own.

Is probation possible for Article 73, paragraph 5?

Yes, it is abstractly possible following judgment no. 90 of 2025 of the Constitutional Court. Admission remains subordinated to the request, other legal requirements, and judicial evaluation of the program. If probation has a positive outcome, the crime is extinguished; this is therefore not the same decision provided for by Article 131-bis.

Can I be accused of drug dealing without having been seen selling?

Yes, if the intention to transfer is proven. Possession for the purpose of dealing can be inferred from multiple convergent elements, such as packaging, communications, money, and custody methods. In the absence of sufficient clues, the mere availability of the substance does not, however, authorize presuming a purpose other than personal use automatically.

An evaluation based on facts

The defense starts from the correct classification of the conduct. Personal use, minor drug dealing, particularly minor nature, and probation respond to different prerequisites and produce different consequences. Quantity and purity are important, but they acquire meaning only together with the methods of the episode, its extension, and the elements regarding the destination of the substance.
