Criminal Lawyer

A drug trafficking accusation does not depend solely on the grams found during a search. What matters are the destination of the substance, the active ingredient content, the packaging, messages, money, and all the circumstances under which the seizure takes place. Even a gratuitous transfer may carry criminal relevance, whereas a non-minimal quantity may be compatible, under certain conditions, with personal consumption.

In this guide, I explain how to distinguish personal use from possession intended for transfer, when an offense can be qualified as of a particularly minor nature, and which elements affect aggravating factors. We will also look at the main procedural paths, including probation for minor drug offenses. The aim is to help you understand which facts can truly change the legal framing of the charge, without confusing a defensive possibility with an already secured outcome.

When Possession Becomes a Drug Trafficking Offense

The term trafficking encompasses many different conducts. Article 73 of Presidential Decree no. 309/1990 punishes not only sale, but also, among other things, offering, transfer, delivery, transport, purchase, and possession intended for non-exclusively personal use. The regulatory framework can be consulted in the text of Article 73 of Presidential Decree no. 309/1990.

It is not necessary to receive money. Gifting a dose or sharing it with another person can constitute a criminally relevant transfer. Profit is certainly an important element when it emerges from evidence, but its absence does not automatically render the transfer of the substance to third parties lawful.

Exclusively personal use instead follows the administrative route. Article 75 governs importation, purchase, reception, and possession carried out for one's own consumption, providing for potential consequences regarding driving licenses, passports, and other documents. This is therefore not lawful conduct, but an offense distinct from the crime provided for under Article 73. Conditions and penalties are indicated in the text of Article 75 of Presidential Decree no. 309/1990.

Quantitative thresholds are not an automatic boundary. Exceeding ministerial limits constitutes an index to be read together with the overall weight, packaging, and other circumstances. Similarly, remaining below a certain threshold does not exclude trafficking if a delivery, offer, or destination to third parties is proven.

What Evidence Distinguishes Personal Use from Transfer

The prosecution must prove the non-exclusively personal destination. When no delivery has been observed, this purpose is often reconstructed through circumstantial evidence. The defense must therefore address their overall meaning, without isolating only the most favorable piece of data or the one that is apparently most serious.

Toxicological analysis is a central point. Gross weight, net weight, and active ingredient quantity are not the same thing. The active ingredient helps estimate the actual consistency of the substance and the number of obtainable doses. It is also necessary to verify that the seized material has been correctly identified, sampled, and linked to the item attributed to the defendant.

Packaging can have different explanations. Multiple pre-separated wrappers may indicate preparation for sale, but they do not settle the matter on their own. They assume a different weight if accompanied by observed deliveries, appointments, accounting records, numerous contacts with buyers, or money consistent with transfer activity.

Scales and cash must also be placed in context. The report by the Office of the Reference Clerk of the Court of Cassation dedicated to the particularly minor nature of the offence recalls that weighing and packaging tools can take on different meanings according to the volume and organization of the activity. The assessment concerns all indicators provided by law, as explored in the report of the Court of Cassation on Article 73, paragraph 5.

Digital data require precise reading. An ambiguous word, an amount, or a photograph does not necessarily prove a sale. What counts are the complete content of conversations, dates, the identity of interlocutors, the actual availability of the device, and correspondence with seizures or meetings. Deleting messages or agreeing on versions with other people, instead, can worsen the evidentiary situation and must be avoided.

When the Particularly Minor Nature of the Offence Can Be Recognized

Minor drug dealing is a less serious autonomous crime. Article 73, paragraph 5, applies when the offence is found to be of a particularly minor nature in terms of the means used, the modalities, and the circumstances of the action, or due to the quality and quantity of the substance. The penalty currently provided for the baseline offense ranges from six months to five years of imprisonment, in addition to a fine.

A modest quantity is not enough. The judge considers the overall offensiveness of the conduct. A few doses transferred in a circumscribed context can point toward paragraph 5; a stable structure, a broad clientele, substantial availability, multiple storage locations, or an articulated organization can instead exclude it, even if the single seizure does not appear high.

Repetition does not always exclude the particularly minor nature. However, current text provides for harsher treatment when minor conduct assumes characteristics of non-occasionality: the minimum imprisonment rises to eighteen months and the minimum fine also changes. It is therefore necessary to distinguish between the contained offensiveness of the fact and its frequency. These are connected assessments, but they do not coincide.

The date of the offense remains decisive. In criminal matters, it is necessary to identify the applicable discipline at the time of the conduct and compare it with subsequent modifications according to the rules on the succession of laws. A harsher provision cannot be automatically transferred to prior acts, while a subsequent more favorable discipline may assume relevance within the limits established by law.

Aggravating Factors, Place of Transfer, and Personal Role

Certain circumstances significantly increase the penalty. Article 80 contemplates, among others, delivery or destination to a minor, offering or transfer inside or in the vicinity of schools, youth communities, prisons, hospitals, and care facilities, as well as the use of weapons, dangerous adulteration, and a large quantity. The complete reference is in the text of Article 80 of Presidential Decree no. 309/1990.

Simple presence in a sensitive place does not replace proof. For the aggravating factor regarding schools, it is necessary to establish where and how the contested offer or transfer took place. The fact that a person is checked in the vicinity does not demonstrate, on its own, that they carried out the illicit activity there.

The contribution of each participant must be individualized. When multiple people are involved, being present in the same car or home does not automatically equal conspiring in drug trafficking. What counts are the availability of the substance, agreements, behavior kept, communications, and the help concretely provided. On the other hand, whoever knowingly stores, transports, or guards can be held liable even without personally carrying out the delivery.

The Main Defensive and Procedural Choices

The first alternative is to contest the charge. If sufficient proof of destination to third parties is lacking, the request may be acquittal or, when the prerequisites are met, the classification of possession under personal use provided for by Article 75. The latter is not an attenuated criminal conviction, but a different administrative offense.

A second path concerns legal qualification. Even when a transfer is proven, quantity, active ingredient, number of episodes, means, and breadth of activity can support the application of paragraph 5. The defense should not limit itself to the expression small quantity: it must link technical data and concrete modalities to the reduced offensiveness required by the provision.

Probation is now possible for minor offenses. With ruling no. 90 of 2025, the Constitutional Court eliminated the exclusion of Article 73, paragraph 5, from the institution. If the judge admits the request, the trial is suspended and the defendant follows a program that includes prescriptions and community service; a positive outcome extinguishes the crime. The decision can be consulted in the ruling of the Constitutional Court no. 90 of 2025.

Access is not automatic. A timely request, a suitable program, and a favorable evaluation by the judge are required. Before choosing this path, it must be compared with the possibility of obtaining an acquittal, a different qualification, or a definition of the trial through a fast-track proceeding or plea bargaining. Each option produces different effects and should not be chosen solely to close the proceedings quickly.

There is also a specific community service option. For minor offenses committed by a drug-addicted or consuming person, Article 73, paragraph 5-bis, allows, under the conditions provided, to replace custodial and pecuniary penalties with such work. It is an institution distinct from probation: it intervenes with the sentence of conviction or plea bargain and also presupposes that conditional suspension should not be granted.

What to Do After a Search, Seizure, or Arrest

Keep all the records received. The indication of the place where each item was found, the people present, the packaging, the seized sums, the acquired phones, and the statements reported are important. An inaccurate description or the indistinct attribution of objects present in a shared space can affect the reconstruction of responsibilities.

Do not improvise explanations without knowing the case files. You have the right to be assisted by a defense counsel and to choose whether to make statements. An immediate, incomplete, or contradictory version can be difficult to correct. This does not mean remaining silent at all times, but deciding after having understood the charge and the elements already gathered.

Gather only authentic and relevant evidence. Medical prescriptions, documentation relating to a therapeutic path, lawful origin of money, or elements clarifying the availability of a premise can be useful when they have a real connection to the accusation. Do not modify files, conversations, or documents: defense is built on the verifiability of facts, not on the subsequent creation of an explanation.

Frequently Asked Questions

Does a small quantity always exclude drug trafficking?

No, quantity is only one of the elements. Even a few doses can be intended for transfer if demonstrated by an observed sale, unequivocal messages, or other evidence. Conversely, a larger quantity does not prove trafficking on its own when the context, active ingredient, and preservation modalities are compatible with personal consumption.

Is gifting a dose to a friend a crime?

Gratuitous transfer can integrate Article 73. The rule does not necessarily require payment or profit. However, it is necessary to prove that there was an actual transfer of the substance to another person; simple joint possession or proximity between multiple subjects cannot be automatically transformed into a transfer.

Does possession of a small scale prove drug trafficking?

Not necessarily. A small scale can reinforce the accusation when associated with packaged doses, orders, accounting, or repeated deliveries. It may instead have a less decisive weight if other data are consistent with personal consumption or an otherwise circumscribed activity. Its meaning depends on the overall evaluation of evidence.

Can I request probation for minor drug trafficking?

Yes, for Article 73, paragraph 5, it is legally possible. Following constitutional ruling no. 90 of 2025, the maximum statutory penalty of five years no longer prevents access. Requests within procedural terms, an adequate program, and a favorable decision by the judge remain necessary; a positive outcome determines the extinction of the crime.

Are personal use and the particularly minor nature the same thing?

No, they produce different consequences. Exclusively personal use falls under the administrative offense of Article 75. The particularly minor nature instead remains a crime of production, trafficking, possession, or transfer, punished less severely than ordinary hypotheses. Destination to third parties is ascertained first, then any reduced offensiveness is evaluated.

What should I bring to the first meeting with the defense counsel?

Bring records and acts already notified. Authentic documentation on the origin of money, any prescriptions or therapeutic paths, and an essential chronology of events are also useful. I advise you not to delete communications and not to reconstruct facts together with other suspects, because every element must retain its reliability.

A Defense Founded on the Correct Legal Qualification of the Offense

Strategy depends on the meaning of evidence, not on a standard formula. Personal use, minor nature, non-occasional conduct, and ordinary offenses have profoundly different prerequisites and effects.
