Being accused of a breach of seals can raise very concrete doubts: is it sufficient to have opened a premises, moved an asset, or let someone enter a restricted area? What changes if the asset was entrusted precisely to you as a custodian? And how should one behave after receiving an instrument from the Prosecutor's Office or the judge?

I want to help you focus on the issue without dangerous simplifications. I will explain what Article 349 of the criminal code protects, why the content of the authority's measure matters as much as the physical gesture, and which alternatives may come into play in criminal defense. The first point is to understand what restriction existed, which asset it referred to, and which behaviors it prohibited.

What Article 349 of the Criminal Code Punishes

The rule protects the effectiveness of seals affixed by the authority. Article 349 of the criminal code concerns seals placed by provision of law or by order of the authority, with the purpose of preserving a thing or maintaining its identity and condition. The asset may be a property, a business, a construction site, a vehicle, machinery, or an object: economic value does not decide the matter, but rather the restriction that prevents free intervention on that thing.

The conduct does not necessarily coincide with the mere gesture of breaking a padlock or tearing a tape. What matters is the concrete circumvention of the arranged protection. Opening a closed access, re-entering a prohibited area, reusing an asset, or modifying its conditions can take on significance if it renders the restriction established by the authority ineffective. Conversely, accidental deterioration of external signs does not prove on its own that someone intentionally breached the seals.

The baseline offense provides for imprisonment from six months to three years; for those entrusted with the custody of the thing, the custodial sentence is higher, ranging from three to five years. The text of Article 349 of the criminal code on Normattiva allows distinguishing between the two hypotheses. The penalty indicated by the law does not anticipate the outcome of the proceedings: first, it must be ascertained whether the attributed fact truly falls within the norm.

The Authority's Measure Defines the Limit to Respect

It is not enough to know that a seizure existed. To understand the accusation, one must read the measure ordering the restriction and the report with which the seals were affixed. Those acts should allow identifying the asset concerned, the purpose of the measure, the instructions given, and the potential appointment of a custodian. A seizure may concern the entire property, a single room, certain systems, or specific materials: the difference can radically change the meaning of the contested action.

Entering a sealed premises to retrieve documents, medicines, or work tools does not become lawful simply because the practical reason appears understandable. Personal necessity does not replace authorization. If the measure prohibits availability of the place, access must occur solely in the ways permitted by the authority. When, instead, a controlled retrieval of specific assets has been authorized, it is necessary to verify whether the operation remained within the indicated limits.

It is important not to overlap different situations. The breach of seals protects the restriction represented by the seals; the misappropriation, destruction, or use of a seized thing may also raise different legal issues. The correct qualification of the fact depends on the contested conduct, the type of measure, and the person's concrete relationship with the asset.

Knowledge of the Restriction and Personal Conduct

Liability cannot be founded solely on the presence of a restricted asset. It is necessary to link a person to a precise conduct and awareness of the prohibition. The seizure report or the record of seal affixing, the notifications, the instructions received, and the person's presence during the operations are elements that can clarify whether the restriction was actually known.

The question is not merely "were the seals visible?". It may be decisive to establish who opened the premises, who ordered access, whether a third party acted without authorization, and what activity was carried out inside. An asset found open does not automatically identify the responsible party. Photographs, reports, communications, available recordings, and any requested authorizations can take on different weight in the reconstruction of the fact.

Neither does subsequent restoration automatically eliminate a contestation regarding behavior that has already occurred. Closing the premises, repositioning an asset, or materially rebuilding a seal may be a fact to be evaluated in its context, but it does not transform an autonomous initiative into an authorized activity. The prudent choice is not to carry out further interventions before knowing which limits remain effective.

Why the Custodian's Position Is More Delicate

The custodian does not acquire the freedom to use the asset. Custody serves to maintain the thing in the condition required by the authority and to prevent others from circumventing the restriction. For this reason, Article 349, second paragraph, provides a harsher sanctioning response for the custodian who breaches the seals or permits the breach.

Being the owner of the property, business proprietor, or possessor of the asset is not always equivalent to being a custodian for the purposes of Article 349. What counts is the formal or concrete entrustment of custody. The measure and the report must clarify who was appointed, what obligations they received, and which asset was entrusted. Ownership remains relevant for other profiles, but it does not remove the limits imposed by the seizure or the seals.

The custodian's position still requires precise proof of conduct. If a third party enters without their consent, if they act despite contrary instructions, or if the custodian had no real possibility of preventing access, these elements are not secondary details. It is necessary to distinguish consent, cooperation, and lack of vigilance, because they describe different situations and cannot be treated as equivalent.

What Changes When a Criminal Act Arrives

The act received indicates the stage of the proceeding, not a conviction. A notice of conclusion of investigations, a summons to trial, or an invitation to appear have different functions. In all cases, it is essential to read the statement of the fact: date, location, asset concerned, contested conduct, potential qualification as custodian, and invoked norm. These are the elements that delimit the accusation to which one must respond.

For the breach of seals, proceedings may follow direct summons to trial, according to the rules of Article 550 of the criminal procedure code; the second paragraph of the article expressly includes the hypothesis of a breach committed by the custodian. The trial ritual also affects the timing of defensive choices. It is therefore not prudent to wait for the hearing without having understood which act has been notified and what faculties it indicates. The framework of direct summons is referenced in the regulations published on Normattiva regarding Article 550 of the criminal procedure code.

Preserve the seizure measure, the seal affixing report, any custodian appointment record, and every communication received. Do not modify or use the asset again to "fix" the situation. If objects need to be retrieved, access obtained, or unsealing requested, the correct path is the one provided by the competent authority, not a personal initiative.

Defense Options: Challenging the Fact or Evaluating Alternative Rituals

The defense starts from the constituent elements of the accusation. The first knot concerns the existence and scope of the restriction: was the asset truly subjected to seals at the indicated moment? The second concerns conduct: what action is attributed to the investigated person and based on which elements? The third concerns knowledge of the prohibition and, if contested, the qualification of custodian.

This analysis does not coincide with an automatic choice to deny everything. If the acts describe a fact different from the one that actually occurred, if access was authorized, or if the link between a person and the conduct is missing, the accusatory reconstruction can be discussed on its essential points. If, instead, the fact is documentally defined, it may be necessary to carefully compare the consequences of ordinary trial and those of admitted procedural instruments.

Suspension of the proceeding with probation is one of the possibilities that may be considered when legal requirements are met. It is not a generic declaration of repentance: it requires an application, a treatment program, and concrete obligations, including community service work. The request, in direct summons proceedings, must be proposed by the conclusion of the pre-trial hearing, as provided by Article 464-bis of the criminal procedure code on Normattiva.

Probation Does Not Erase the Need to Evaluate the Accusation

Probation suspends the proceeding if the judge admits it. The institution concerns offenses falling within the limits provided by Article 168-bis of the criminal code and those expressly referenced by law. For the basic form of breach of seals, the maximum penalty falls within the ordinary limit; for the custodian hypothesis, the reference to crimes indicated by Article 550, second paragraph, of the criminal procedure code is also relevant.

The program may provide for conduct to eliminate or mitigate the harmful or dangerous consequences of the offense, volunteer activities, prescriptions, and community service work. Admission is not automatic, and the program must be achievable. The Ministry of Justice describes probation as suspension of the proceeding accompanied by a path carried out with the involvement of the Office of External Criminal Execution in the institutional page on probation and trial suspension.

If the probation has a positive outcome, the judge declares the extinction of the offense; if prescriptions are not respected or probation has a negative outcome, the proceeding continues. The choice does not replace verification of the accusation's soundness. It may be reasonable to consider it when requirements exist and obligations are sustainable, but it should not be adopted solely out of fear generated by the name of the offense or the abstract penalty.

However, actual entrustment of the asset, communicated obligations, and personal conduct of breach or consent to breach must result: the mere quality of owner is not enough.

Can I request probation for breach of seals?

It can be an option provided by law. The possibility depends on the qualification of the fact, personal requirements, the timing of the proceeding, and the setup of a program with real obligations. A potential positive outcome extinguishes the offense, but admission is not automatic and does not prevent verifying whether the accusation is well-founded.

How to Face a Contestation

The priority is not to add new conduct on the restricted asset. Preserve the acts, identify the measure from which seizure and seals derive, and do not confuse an immediate need with authorization.
