Analysis of Judgment Cass. pen., Section I, No. 3030 of 2023: Liability and Aggravating Circumstances in the Mafia Context
In judgment no. 3030, filed on 24 January 2023 following the hearing of 9 December 2022, the First Criminal Section of the Court of Cassation examines several appeals against a decision of the Naples Court of Appeal. The issues include the relationship between a mafia association and drug trafficking, and the aggravating circumstance under Article 416-bis.1 of the Italian Criminal Code.
Mafia methods and the purpose of facilitating an association
The judgment distinguishes the use of mafia methods from the purpose of facilitating the association. For the latter, it recalls that this subjective aggravating circumstance can extend to a participant who knows the purpose pursued by another participant, even without sharing that purpose.
In the case examined, the lower courts had established a connection between the associations and the role of drug trafficking in financing the mafia group. The Court of Cassation refers to statements by cooperating witnesses and corroborating wiretap evidence, without automatically treating the two associations as identical.
Assessing each defendant's responsibility
The appeals have different outcomes: some are declared inadmissible, some are dismissed and others are allowed with a remand. For one defendant, the Court sets aside the findings concerning participation in the drug-trafficking association and the mafia aggravating circumstance because the reasons do not explain the defendant's specific contribution and awareness of the associative links.
The criminal context therefore does not replace an assessment of the evidence concerning each individual. The court hearing the case on remand must also give specific reasons for attributing the aggravating circumstance to that defendant.
