Receiving a separation petition can create a sense of urgency and disorientation. You may wonder whether you must leave the home immediately, whether the other spouse's requests will automatically become binding, what effect the proceedings will have on the children, and how to respond without worsening the situation. The petition does not decide the separation or its conditions on its own: it opens a legal proceeding in which you have the right to make your position known.

In this guide, I want to help you distinguish what requires immediate attention from what will be decided after the parties have confronted each other. We will look at what to check in the petition and in the hearing setting decree, why the deadline indicated by the judge is decisive, which issues concern children, the home, and financial contributions, and when an agreement can remain a concrete path.

The petition opens a proceeding, but does not make all requests true

Judicial separation begins when one spouse files a petition because a complete agreement on the conditions of separate living does not exist. Different claims may appear in the petition: the pronouncement of separation, custody and placement of children, periods of time spent with each parent, maintenance, use of the family home, and, in some cases, the allocation of fault for the separation.

Reading the document carefully serves to separate the facts alleged by the other spouse from the claims addressed to the judge. A statement contained in the petition is not already formed evidence, and a financial request does not become due simply because it has been formulated. The defense must nevertheless take a position on the points that matter, indicating which facts are contested, which circumstances need to be clarified, and which alternative requests you consider correct.

Personal separation does not dissolve the marriage and does not automatically transfer the ownership of assets. It primarily regulates the cessation of cohabitation and the personal and economic relationships between spouses and children during the separation. For this reason, it is important not to confuse the separation proceeding with property division: a home, an account, or real estate may raise additional issues, different from the temporary assignment of the family home.

The decree attached to the petition is as important as the petition itself. It indicates the hearing, the deadline by which the respondent spouse must enter an appearance, and essential information about the proceeding. Under the procedure for persons and families, the petition must contain facts, claims, evidence, and documents; the judge then sets the hearing and assigns the appearance deadline to the party receiving the document. You can consult the normative text on the unitary procedure for persons, minors, and families, in particular articles 473-bis.12, 473-bis.14 and following of the code of civil procedure.

The first step is to comply with the appearance deadline

You must not calculate the deadline solely from the date you read the petition. The useful deadline to enter an appearance is the one indicated in the judge's decree. The law establishes that the respondent's appearance must take place at least thirty days before the hearing; between notification of the petition and the hearing, at least sixty clear days must normally elapse. The concrete date to respect remains the one stated in the provision you received.

Entering an appearance means filing, through a lawyer, a statement of defense: the document by which you set out your position, formulate any claims, and produce documents and evidence. Technical defense is mandatory, barring special situations that do not coincide with ordinary separation proceedings. Postponing the reading of the documents or limiting yourself to sending messages to the other spouse does not replace entering an appearance in the process.

Compliance with the deadline is not a formality. A late appearance can entail preclusions, meaning the loss of the opportunity to promptly raise certain exceptions, claims, or evidentiary requests. Protections concerning minor children remain unaffected, because the legislature allows parties to introduce claims and evidence regarding their custody and maintenance even at a later stage. This protection of children does not make it prudent to ignore the deadline: property and defensive issues between spouses must be set up from the beginning.

Also check that both the petition and the hearing setting decree have been notified, that personal data are correct, and that essential attachments are not missing. If prior provisions on children, maintenance, or the family home exist, they must be read together with the new requests. Chronology is often decisive: a prior agreement, a change in income, or a transfer that has already taken place can alter the meaning of the formulated claims.

Children: the judge decides by looking at their concrete lives

The separation of parents does not eliminate either person's role in the upbringing of the children. The judge must adopt provisions that take into account the best interests of minors, the continuity of their relationships, and daily needs. Joint custody, primary placement, and visitation times are different concepts: custody concerns parental decisions; placement identifies where the child primarily lives; times regulate presence with the other parent.

To explain what solution is sustainable, generic formulas such as "joint custody" or "equal placement" are not enough. What counts are the school, distances, work schedules, activities, health, and the actual habits of the child. The parenting plan attached to the documents serves precisely to represent daily commitments, habitual associations, and vacations. It is not a decorative document: it helps the judge connect the decision to the real life of the minor.

A child who has reached the age of twelve, and even a younger one if capable of discernment, may be heard when provisions concerning them are to be adopted. Hearing the child does not place the weight of choosing between parents upon them. It serves to bring out their point of view in serene conditions, which the judge considers together with other relevant elements.

Avoid turning children into messengers, witnesses to the conflict, or instruments to achieve a better financial condition. If the petition describes worrisome facts concerning their safety or relationship with either parent, the response must be precise: one must distinguish a dispute between adults from circumstances that truly affect the minor's well-being. Procedure rules grant the judge specific powers for the protection of children and also govern the hearing of the minor. The reference is found in legislative decree no. 149 of 2022, under articles 473-bis.2 and 473-bis.4 of the code of civil procedure.

Maintenance, home, and fault require distinct plans

The child support contribution and spouse maintenance are different claims. For children, both parents remain bound to contribute to their needs in proportion to their respective resources and concrete care arrangements. For a spouse, any maintenance allowance follows its own prerequisites: separation and economic disparity do not automatically lead to a predetermined amount.

Economic conditions must be represented comprehensively. In proceedings involving financial claims or minor children, the rules require tax returns for the last three years, documentation on real estate, registered movable property, and corporate shares, as well as bank and financial statements relating to the same period. Omissions and incomplete information can have consequences in the proceeding, because the judge can order additions, disclosures, and investigations regarding income, assets, and standard of living.

The family home is not assigned based solely on the title of ownership. If children are present, their need for housing continuity carries central weight; this does not mean the assignment is automatic or resolves the property ownership of the real estate. Ownership, mortgage, rental fee, and home assignment are different levels, which must be examined without overlapping them.

If the petition requests the allocation of fault for the separation, the issue is not establishing who suffered the most in the crisis. It is necessary to verify whether a violation of marital duties is alleged and whether that conduct is indicated as the cause of the breakdown of cohabitation. Merely unpleasant behavior or an already irreversible crisis do not automatically coincide with fault. Dates, messages, documents, and testimonies acquire relevance only if they clarify specific facts and their relationship with the end of shared life.

The corrective reform of 2024 specified, among other things, territorial jurisdiction and the obligation to attach economic-patrimonial documentation also to the statement of defense in separation proceedings. You can read legislative decree no. 164 of 2024, which amends articles 473-bis.47 and 473-bis.48 of the code of civil procedure.

The first hearing can set provisionally effective rules right away

At the first hearing, the parties must normally appear in person, barring serious and proven grounds. The judge listens to the spouses, even separately when necessary, and attempts conciliation. This does not mean you must accept a proposal you do not consider sustainable: it means the proceeding leaves room for an agreed solution if a serious basis exists to build one.

If an agreement is not reached, the judge can adopt temporary and urgent provisions concerning children, the home, and financial contributions. These are decisions intended to regulate the trial phase, not always the final arrangement, but they can be immediately enforceable. The order may also indicate the date from which a financial contribution starts, with the possibility provided by law to make it retroactive up to the petition.

In the presence of new facts or subsequent findings, temporary provisions can be modified or revoked. Against appealable ones, article 473-bis.24 provides a peremptory deadline of ten days from pronouncement at the hearing or from communication or notification, if prior. Not every disagreement requires the same remedy: one must understand the content of the order, the immediate effects, and the concrete reason why the measure is challenged.

Before the hearing, it is useful to keep available the documents received, tax returns, bank statements, documents relating to the home, major expenses for the children, and an orderly overview of daily commitments. Collecting indiscriminate material is not necessary. Documents that respond to the claims actually brought forward are needed, allowing one to distinguish a demonstrable fact from a simple personal reconstruction.

Defending yourself does not exclude the possibility of an agreement

The statement of defense can contain a firm position while at the same time leaving open a confrontation on practical conditions. Defending yourself means preventing unshared requests from remaining without reply; it does not mean having to turn every aspect of the separation into a permanent opposition. An understanding can cover all points or only some, such as the children's schedule or the management of extraordinary expenses.

When a complete agreement emerges, the parties can move toward joint petition proceedings. The judge may ask for clarifications and, if children are present, checks that the conditions are not contrary to their interests. An agreement works when it is concrete and applicable: it must indicate times, contributions, allocations, and understandable rules, rather than simply postponing difficult decisions to an indefinite future. Frequently Asked Questions

Must I leave the home immediately if I receive a separation petition?

No, the petition alone does not automatically require leaving the dwelling. One must read whether the judge has already issued an urgent provision and what requests have been formulated. Staying in the home, its eventual assignment, and property ownership are distinct aspects. Before making decisions that impact children's lives or property relations, understanding the content of the documents is important.

Can I enter an appearance without a lawyer?

In judicial separation proceedings, defense by a lawyer is mandatory, as the hearing setting decree must indicate. The judge assigns a deadline to enter an appearance and also points out the possibility of requesting admission to legal aid at state expense if statutory conditions are met. A message or letter to the other spouse does not replace the statement of defense.

If I disagree with the requested maintenance, must I pay it immediately?

The request contained in the petition is not inherently a payment order. However, the judge may establish provisional contributions at the first hearing or through urgent provisions, and such measures can be enforceable. For this reason, the economic situation must be represented comprehensively and promptly, distinguishing effective income, assets, necessary expenses, and children's needs.

Can I request different times with my children compared to those proposed in the petition?

Yes, you can formulate a concrete alternative proposal. Asking for more time in the abstract is not sufficient: it is useful to connect the proposal to school, distances, work, activities, vacations, and the ability to organize daily life. If circumstances change during the proceeding, issues concerning minor custody and maintenance remain heavily protected.

Does the first hearing definitively close the separation?

As a rule, no. At the first hearing, the judge listens to the parties, attempts conciliation, and if there is no agreement, can issue temporary and urgent provisions. The proceeding continues for issues requiring evidence or deeper examination. An agreement reached subsequently can still change the path, provided the conditions are clear and adequately protect the children.

An orientation before the deadline

The priority is understanding by what date you must enter an appearance and what is truly requested. Then one must distinguish the points on which to defend yourself, those requiring documents, and those where room for agreement may exist.
