Prenuptial agreements can help you put economic relations in order before the wedding, but in Italy they do not work as a contract capable of deciding once and for all every consequence of a future separation. If you want to protect sums invested in the other partner's home, keep purchases separate or regulate a loan between future spouses, useful tools exist. However, it is necessary to choose the one consistent with the purpose.
I will therefore explain to you what you can truly agree upon, which clauses risk being ineffective or null and why it is decisive to distinguish an agreement on specific assets and debts from the preventive waiver of family rights. We will also see what changes in the presence of children, real estate, an economic activity or assets connected to multiple countries.
There is no general model equivalent to the prenuptial agreement of some foreign legal systems, automatically binding on assets, maintenance, children and the family home. The autonomy of future spouses encounters limits when the agreement concerns rights and duties deriving from marriage or intends to replace assessments that must be made at the time of separation or divorce.
Article 160 of the civil code prevents spouses from derogating from the rights and duties provided by law as a result of marriage. Articles 159 and 162 instead regulate the legal property regime and the form of marital property conventions. The regulatory framework can be consulted in the current text of the civil code on Normattiva. Private will cannot erase legal obligations such as assistance, collaboration and contribution to family needs.
The name of the document does not determine its validity. A text titled “prenuptial agreement” may contain valid provisions, ineffective clauses and void dispositions. Documenting a loan already made is different from waiving any future economic support today, without knowing the duration of the marriage, incomes, health, children or the couple's professional choices.
A concrete economic agreement is not unlawful solely because separation represents the event from which the obligation to pay or return a sum arises. The central issue is the reason for the agreement: it must regulate an identifiable property relationship, not trade marital status or preventively eliminate unavailable protections.
With ordinance no. 20415 of July 21, 2025, the Court of Cassation recognized the validity of an agreement intended to settle property relations in the event of a marriage crisis. The separation operated as a condition of the agreement, while the economic reason derived from contributions destined for the restoration of a property belonging to the other spouse and from reciprocal property attributions. The reference is in the Civil Review of the Court of Cassation for July and August 2025.
The decision does not make any pact valid. It confirms the distinction between the settlement of investments, debts and specific assets and the preventive disposition of rights that depend on the future family crisis. Separation can make a credit already justified by an autonomous cause enforceable; it does not automatically transform every promise into a lawful contract.
The nature of the payment must be clear. If you finance the renovation of a house owned by the future spouse, it is necessary to distinguish a loan to be returned, a gratuitous contribution, the purchase of a share of the property and an expense incurred for common life. These alternatives produce different effects on ownership and possible reimbursement.
A specific agreement can indicate the amount, the origin of the sums, their destination and the moment in which the credit becomes enforceable. If instead the payment appears as a liberal act or an ordinary contribution to the family, the end of the relationship does not create by itself a right to restitution. Bank transfers and receipts prove the payment, but do not always explain why it was executed.
Individual property relations can be regulated, such as ownership shares, expense distribution, financing or obligations linked to an economic activity. The necessary form depends on the operation: a written document can document a debt, while the transfer of real estate rights requires a suitable deed and the formalities provided by law.
Generic expressions such as “each will recover what was paid” leave decisive questions open: which sums, destined for which asset, proven in what way and returned according to which criterion. Precision protects both parties and makes it possible to distinguish a personal investment from expenses incurred in the interest of the family.
The property regime regulates purchases made during marriage, but does not decide all the consequences of its eventual cessation. If the spouses do not choose otherwise, legal communion operates. Separation of property can be declared in the marriage act; other marital conventions require public deed and the formalities necessary to make them enforceable against third parties.
Separation of property does not mean the absence of economic ties. Each spouse retains ownership of their purchases, but both must contribute to family needs according to their respective resources and work capacity. They can also buy a property together, sign the same mortgage, lend money to each other or assume common obligations.
The choice of regime does not even prove that a payment executed in favor of the other must be returned. It is useful to keep the two levels distinct: the marital convention regulates the property regime; a specific contract can document a loan, an investment or a specific property attribution.
A general and anticipated waiver of any separation or divorce maintenance does not offer the certainty often attributed to it. Divorce maintenance is decided by considering the conditions existing at the time of the crisis and the criteria of Article 5 of Law no. 898 of 1970, which can be consulted in the current text of the divorce law.
Economic resources, duration of the marriage, contribution given to family life and consequences of shared choices can assume relevance. A clause by which a person declares to have never anything to claim affects a future protection and still devoid of its prerequisites. It is different to regulate the reimbursement of an economic contribution already identified and based on an autonomous property relationship.
The best interests of children are evaluated in the concrete situation. Future spouses can discuss the family project, but cannot irrevocably establish custody, visitation times, residence or maintenance of children who might be born. Decisions must consider the age, needs, relationships and actual conditions of the parents at the time of the crisis.
The same limit concerns the family home. Ownership of the property remains relevant, but its eventual assignment in case of separation is linked above all to the interest of cohabiting children. A preventive pact cannot neutralize this function nor deprive children of the right to maintenance.
The agreement cannot impose a future separation nor make consent to a joint solution irrevocable. Clauses constructed to unduly condition the freedom to request separation or to replace the mandatory rules of family law with a penalty are also fragile.
It is different to establish that, if separation occurs, an already recognized debt becomes enforceable. In this case the crisis is only the event foreseen for fulfillment: the obligation has its own economic reason, such as the restitution of financing or the settlement of previous property attributions.
It is not enough to sign a generic model. A marital convention, a loan, a donation, a debt recognition and a real estate transfer have different forms and effects. Separation of property can also be chosen during the celebration; a subsequent convention instead requires the public deed provided by the civil code.
The document must identify assets and sums, specify the origin of resources, explain the reason for the attribution and indicate the assumed obligations. It is appropriate not to mix property, maintenance, children and general waivers into a single formula. Distinct clauses make the function of each provision understandable and limit the consequences of an eventual invalid point.
Both must give free and conscious consent. Incomplete financial information, pressure exerted close to the wedding or incomprehensible conditions can fuel disputes. Transparency and balance are important, but do not make a clause contrary to mandatory rules lawful nor replace the form required for the single act.
The agreement can be concluded before marriage, but some tools remain usable even afterwards. The decisive question is not only when to sign: it is necessary to understand whether you want to choose the property regime, document an already arisen relationship or discipline a future operation. The tool follows the objective, not the label chosen by the parties.
Enforceability against third parties requires the statutory formalities. Article 162 of the Civil Code links enforceability of matrimonial property agreements to annotation of the required information in the margin of the marriage record. Amendments also require a public deed and the consents specified in Article 163; the relevant annotations are needed for effects against third parties. A later choice does not automatically rewrite ownership of assets already acquired or cancel earlier obligations or guarantees.
The family asset fund (fondo patrimoniale) is not general asset protection. Article 167 permits specified immovable property, registered movable property or securities to be allocated to family needs. Article 170 limits enforcement against the fund’s assets and their fruits for debts which the creditor knew had been incurred for purposes unrelated to those needs. The fund therefore does not provide immunity from every creditor or replace the instruments needed for corporate relationships.

If you want to keep future purchases separate, separation of property is normally the first tool to consider. However, it does not automatically return what you invest in another person's property, it does not eliminate family obligations and it does not prevent the application of rules on maintenance when the prerequisites are met.
If you are financing someone else's asset, it is more useful to define the nature of the contribution. It may be a documented loan, the purchase of a share, a reimbursement agreement or a gratuitous attribution. The choice changes who becomes the owner, what evidence is needed and what can be requested later.
If you want to protect an economic activity, it is necessary to distinguish enterprise ownership from any financing by the other spouse, personal guarantees and joint purchases. Separation of property does not cancel contracts signed together and does not protect someone who personally assumes a debt or provides a surety.
If the crisis has already begun, the prenuptial pact is no longer the central tool. Economic conditions can be defined in agreements and proceedings provided for separation and divorce, with the controls required by law and with particular attention to children. In that setting, current facts are considered, not just forecasts formulated before the wedding.
In international couples, applicable law matters. Regulation (EU) 2016/1103 allows spouses or future spouses, within specific citizenship or habitual residence connections, to choose the law governing their property regime. The European regulation on property regimes between spouses also establishes formal requirements, applicable criteria in the absence of choice and transitional provisions.
The choice of property law does not automatically regulate maintenance, children, validity of marriage or succession, which follow separate disciplines. Furthermore, the regulation rules on applicable law concern spouses who contracted marriage or made the choice after January 29, 2019. International connection therefore requires separating the different matters with precision.
The first error is trying to foresee everything. A document that claims to define every effect of a future divorce in a few lines risks being unreliable precisely in the most important points. It is preferable to identify concrete operations, assets and obligations, without transforming the agreement into a general waiver of family protections.
The second error is confusing property and payments. The registration of a property indicates who owns it, but does not necessarily clarify the nature of the sums paid by the other. Similarly, contributing to expenses does not automatically attribute a share of the asset. Ownership and credit are different issues and require distinct tools.
The third error is relying on vague causes and clarifying the relationship only after the crisis. Receipts and bank transfers can show that money was transferred, but not always whether it was lent, donated or destined for common needs. Documenting the economic reason immediately reduces uncertainty, provided the agreement respects mandatory rules and legal forms.
They can be if they have a lawful and specific content. It is possible to regulate certain investments, debts or property attributions even by linking the effects to a future separation. However, a document that claims to establish every consequence of divorce or to derogate from mandatory rights and duties does not offer reliable protection.
A general waiver does not guarantee effectiveness. Maintenance is evaluated by considering the conditions existing at the time of divorce and the criteria provided by law. It is different to agree on the restitution of specific financing: in that case the pact concerns an autonomous property relationship, already identified and supported by its own economic reason.
It protects individual ownership of purchases according to the rules of the chosen regime, but does not eliminate debts signed together, voluntary co-ownerships, contribution obligations or credits arisen between spouses. Furthermore, it does not prevent the application of rules on maintenance, children and the family home when the respective prerequisites are met.
Not in an irrevocable and binding way. Provisions regarding children must protect their concrete interest at the time they are adopted. A shared project can guide the couple's choices, but does not exclude the controls provided by law and cannot deprive children of the right to care and maintenance.
It depends on the foreseen operation. Separation of property can be declared during the celebration of the marriage. Marital conventions concluded otherwise and real estate transfers instead require specific forms and, normally, notary intervention. A simple writing does not produce the effects for which the law requires a public deed or advertising formalities.
A useful agreement does not try to foresee every event, but distinguishes the property regime, asset ownership, financing between partners and family protections that cannot be eliminated in advance.
