Confiscation and statute of limitations: the Court of Cassation clarifies with judgment no. 15868/2025 the autonomy of different grounds for appeal

With ruling no. 15868/2025, the Third Criminal Section of the Court of Cassation defines the scope of the legitimacy review: when an appeal is inadmissible on grounds of culpability, the judge cannot consider the supervening statute of limitations, even if the sentence is annulled solely regarding confiscation.
