Drunk driving and community service: Cassation n. 13150/2025 clarifies when an accident precludes penalty substitution

With ruling no. 13150 filed on April 4, 2025, the Fourth Criminal Section of the Court of Cassation once again addresses the perennial issue of the ratio and the limits of applying community service as a substitute penalty for drunk driving (Art. 186, paragraph 9, Highway Code). The case originated from an appeal filed by the Public Prosecutor against the decision of the Court of Forlì, which had granted C. Z. the substitution of the penalty, despite the car impacting a guardrail. The judgment of legitimacy overturns the outcome and provides a precise definition of "accident" that is decisive for preclusion.

The reference regulatory framework

Art. 186 of the Highway Code provides for differentiated penalties based on the detected blood alcohol level. Paragraph 9 allows for the substitution of custodial and pecuniary penalties with community service, unless the driver has caused an accident. However, the law does not specify what is meant by an accident: involvement of other vehicles? Damage to persons? Simple loss of control of the vehicle? The lack of a clear definition has led to inconsistent application and litigation.

The principle established by the Court of Cassation

In matters of drunk driving, the preclusive condition for the substitution of custodial and pecuniary penalties with community service consists of having caused an accident, understood as any unexpected event that interrupts the normal flow of road traffic and is likely to cause danger to the community, regardless of whether third parties or other vehicles were involved.

The Court reiterates the orientation already expressed in 2012 (Cass. n. 47276/2012) and in 2019 (Cass. n. 27211/2019), but reaffirms it clearly: an accident is any event that, even without causing damage to property or persons or involving other users, interrupts normal circulation and creates danger. In the specific case, the impact with the guardrail resulted in partial obstruction of the roadway, which was sufficient to constitute the preclusive circumstance.

Operational implications for defendants and lawyers

  • Ex ante evaluation: even at the preliminary defense stage, it is necessary to verify if there was any impact or anomalous event that caused a halt or slowdown in traffic.
  • Burden of proof: the public prosecutor must prove that the event affected the regular flow; it is not necessary to prove damage, but it will be sufficient to document the interruption (photos, traffic reports, testimonies).
  • Plea bargaining and alternative proceedings: the prospect of community service remains viable only if the event does not fall within the broad definition of an accident. A careful defense will need to consider whether to focus on other mitigating circumstances or on non-punishability due to particular tenuity.
  • Effects on criminal record: failure to substitute entails the application of a custodial penalty (often suspended) with a pecuniary sanction and license suspension, affecting previous and future criminal offenses.

Interactions with European legislation

Although the Highway Code falls under national competence, the principle of road safety and prevention is harmonized with European directives on minimum safety levels. The extensive interpretation of the concept of accident aligns with the obligation of Member States to ensure high standards of protection for vulnerable users, as reiterated by Directive (EU) 2015/413 on the exchange of information on road traffic offenses.

Conclusions

Ruling no. 13150/2025 reinforces a restrictive approach to accessing community service, prioritizing the protection of the community over individual rehabilitative needs when traffic is endangered. For drivers and legal professionals, this means reconsidering defense strategies and carefully weighing the factual reconstruction: even the most trivial impact, if it creates danger or slowdown, can be sufficient to eliminate the substitute benefit.
