Majority does not automatically end maintenance, but it does not compel parents to endlessly support an adult child either. If you are dealing with prolonged university studies, precarious work, job loss, or a child's scarce willingness to find employment, it is natural to wonder which fact is truly decisive.

In this guide I explain how to distinguish temporary difficulty from a lack of autonomy attributable to inertia, what relevance age, studies, and job characteristics assume, and why it is not enough to stop payments on your own initiative. We will also see when to request the revocation of the allowance, when a reduction may be more appropriate, and what elements allow the judge to reconstruct the concrete situation.

Maintenance does not end at eighteen

There is no automatic age deadline. The adult child retains the right to maintenance until economic independence is achieved, provided that the lack of autonomy finds a coherent reason in the training path, the serious search for a job, or objective obstacles. Therefore, the eighteenth birthday, the end of high school, or a specific age indicated in the abstract are not sufficient on their own.

Article 337-septies of the civil code allows the judge to order a periodic allowance in favor of the economically dependent adult child. Articles 315-bis and 316-bis also link maintenance to the child's abilities, inclinations, and aspirations, and require parents to contribute in proportion to their respective resources. You can consult the testo consolidato del codice civile.

Support has an educational and formative function: it must accompany the child toward realistically achievable autonomy, without indefinitely replacing personal responsibility. For this reason, the answer changes as the years pass. A newly of-age individual regularly enrolled in university is not in the same position as an adult who finished training some time ago and is only waiting for the ideal job.

The situation of the adult child with severe disability requires a separate evaluation. The second paragraph of Article 337-septies extends the provisions established for minor children to this condition: it is therefore incorrect to automatically apply ordinary criteria regarding entry into the labor market without considering the specific protection provided by the law.

What economic independence means

Economic independence requires income concretely adequate to allow the child to provide for personal needs. It does not necessarily coincide with an open-ended contract, high remuneration, or the dreamed-of job. What counts is the effectively acquired capacity to support oneself, evaluated together with professional preparation, age, type of occupation, and the real context of the labor market.

The name attributed to the relationship does not resolve the issue. A fixed-term contract can demonstrate the achievement of autonomy if it has significant duration, adequate remuneration, and content coherent with concrete working capacity. A very brief internship, a few occasional services, or a symbolic compensation may instead not be sufficient. The Rassegna civile 2021 della Corte di cassazione explicitly recalls the need to consider the duration and remuneration of the relationship.

Cohhabitation alone is not decisive. A child can live with a parent while having income that allows self-support; conversely, they can live away from home to attend university without being economically independent. Residence, material support received, and the way expenses are met are clues to be read together, not labels that automatically produce the cessation or permanence of the allowance.

Even work not perfectly corresponding to the degree of study can be relevant. With the consolidation of adulthood, the child must compare aspirations with effectively accessible opportunities. Maintenance does not guarantee the unlimited wait for an occupation identical to the desired one, especially when reasonable alternatives compatible with already acquired skills exist.

Studies, delays, and job search

A serious course of study normally justifies support, especially when the child has recently come of age and continues higher, university, or specialized training without interruptions. Enrollment, however, is not always enough: effective participation, exams passed, progression of the path, and the reasons for any delays assume relevance.

Being behind schedule does not automatically determine cessation. A contained delay may depend on the difficulty of the course, health problems, reasonable training changes, or other documentable impediments. The evaluation changes when, for a significant period, no exams, educational activities, or concrete explanation appear, and the study path appears used solely to postpone entry into work.

After training, verifiable commitment in the search for employment counts. Coherent applications, participation in selections, useful professional training courses, and availability toward compatible jobs can demonstrate real activation. The repeated and unjustified refusal of adequate opportunities, a search limited to a single ideal position, or total inactivity can instead support a request for cessation.

Age acquires growing weight. The Rassegna annuale 2023 della Corte di cassazione, recalling ruling no. 26875 of 2023, distinguishes the newly of-age individual inserted in the ordinary study path from the adult child, from whom more rigorous proof of the objective obstacles preventing autonomy is required.

What facts must be proven

Whoever requests a modification must indicate new and concrete facts. To obtain cessation, it is not enough to state that the child is now grown or could work. It is necessary to represent what has changed compared to the current provision: completion of studies, hiring, perceived income, development of professional skills, refusal of opportunities, or prolonged absence of initiatives.

At the same time, the adult child claiming the continuation of maintenance must make it understandable why autonomy has not yet been reached. The level of proof is not identical at every age: regular attendance of a course may be sufficient for a young person at the beginning of the path, while after many years the results obtained, searches carried out, and external impediments assume greater importance.

Documents must prove the disputed point, not accumulate generic information. University certifications and exams clarify the effectiveness of studies; contract, pay slips, and duration of the relationship help understand labor autonomy; applications and call-ups document the job search. The economic conditions of both parents also count, especially to decide the measure of any contribution.

The economic worsening of the obligated parent does not automatically make the child independent. However, it can justify a reduction of the amount if it modifies the economic balance upon which the previous decision was based. Revocation and reduction address different questions: the first concerns the failure of the right, the second adapts the contribution to changed resources and needs.

How to request cessation or reduction

An allowance established by the judge must not be suspended unilaterally. Even when the parent believes the child has found a job or is not committing, the provision continues to produce effects until modified. Spontaneously interrupting or decreasing payments can cause arrears to mature and open a new conflict over non-fulfillment.

The ordinary path is the request for revision, based on supervening justified reasons. Article 473-bis.29 of the civil procedure code allows requesting the modification of provisions regarding economic contributions at any time; the provision can be consulted in the testo della riforma del processo familiare.

Presenting the request promptly is important. The Corte di cassazione has stated that the original provision remains effective until its modification and that the effects of the revision run, generally speaking, from the date of the request. The discovery of hiring that occurred months earlier does not therefore authorize canceling autonomously what was due according to the current title.

If there is agreement, conditions can be modified with a joint request or, in foreseen cases, through assisted negotiation. Article 6 of decree-law no. 132 of 2014 also regulates agreements concerning the maintenance of non-self-sufficient adult children and the modification of already established conditions. The testo vigente sulla negoziazione assistita provides for the control of the public prosecutor when non-independent adult children are involved.

To whom the allowance must be paid

Direct payment to the child does not automatically follow the birthday. Article 337-septies provides that the allowance ordered in favor of the adult is paid directly to the entitled party, barring a different decision by the judge. If the existing provision already orders payment to the other parent, the modality should not be changed on the sole initiative of the obligated party.

The cohabiting parent who continues to concretely support the child's expenses may have their own interest in the continuation of the contribution, while the child holds the right and can advance their own request. The choice of recipient must therefore reflect the real organization of maintenance: who pays for housing, board, studies, and other ordinary needs.

What happens if the child loses the job

Job loss does not always revive maintenance. If the child had achieved true autonomy through adequate work, subsequent unemployment does not automatically restore the previous obligation. The case is different if the relationship was so short or poorly paid that it never produced concrete independence.

It is therefore necessary to distinguish between effectively achieved autonomy and simple occasional work experience. If maintenance has ceased and the child subsequently finds themselves in a state of need without being able to provide for essential necessities, the different discipline of alimony may assume relevance. Maintenance and alimony have different prerequisites and functions and must not be treated as the same provision.

Frequently asked questions

Does maintenance automatically end at eighteen?

No, majority is not enough. The obligation continues if the child is not economically independent and is seriously completing training or actively looking for a job. However, majority changes how responsibilities and evidence are evaluated, especially when a long time passes since the conclusion of studies.

Is there a maximum age, like twenty-six or thirty?

The law does not establish a general maximum age. With increasing age, however, the verification of reasons preventing autonomy becomes more rigorous. An adult child must demonstrate commitment in training or work and concrete obstacles, unable to base the right on the mere lack of employment.

Can I stop paying if my child has a fixed-term contract?

Not without modifying the current title. The fixed-term contract can demonstrate autonomy if duration and remuneration are adequate, but not every precarious relationship produces this effect. If the allowance is foreseen by a sentence or effective agreement, it is necessary to formally request its revision rather than suspend payments.

Can maintenance cease if the child refuses a job?

Yes, if the refusal is unjustified and concerns a reasonable opportunity. Compatibility with preparation, offered conditions, market, and overall conduct count. A single motivated refusal does not always equate to inertia; repeated refusals of adequate jobs can instead show that the lack of autonomy depends on the child's choices.

If my child loses the job, can they request maintenance again?

Not automatically. If true economic independence had been achieved, subsequent loss of employment normally does not revive the previous right. If the work was too short or poorly paid, it might never have produced autonomy. Any state of need must also be distinguished from the different request for alimony.

Can I pay the allowance directly to the adult child?

The modality depends on the applicable provision. Article 337-septies ordinarily provides for direct payment to the child, barring a different decision by the judge. If the sentence still orders payment to the other parent, it is prudent not to change recipient unilaterally: the modification can be agreed upon or formally requested.

How to orient yourself before deciding

The correct question is not just how old the child is, but what autonomy has truly been acquired and what was done to achieve it. Effective studies, quality of work, duration of income, job search, and causes of delays allow distinguishing difficulty worthy of support from inertia.
